Hard Work Martial Arts Updated Terms of Service & Membership Agreement
Membership Agreement
• "Purchaser" will refer to the signatory of this document. "Membership Agreement" refers to the contract agreement here in written. "Hard Work Martial Arts" and "HWMA" refer to the business entity "Hard Work Martial Arts LLC" as well as any subsidiaries, employees, owners, or associates.
• Purchaser may purchase memberships for people in their care as a guardian or legal custodian. In that case the purchaser will attest for any responsibilities of the attending individual under their care.
• 1 Year Memberships: Purchaser understands that 1 Year Memberships automatically transfer to a Month to Month Membership status at the end of the agreement initial term of 12 months of full monthly payments. Prorated, credited, or discounted payments do not count towards this limit, starting on the first month after enrollment. This adjustment is automatic.
• 1 Year Memberships: Purchaser understands that no cancellation during membership term is permitted without military or
medical notice. With Military or Medical notice, 30 day notification and a copy of medical or military orders are required.
• Month to Month Memberships: Purchaser understands that cancellations require 30 days written notice, emailed to
• 3rd Party Memberships: Purchaser understands that not all programs are owned and operated by Hard Work Martial Arts, in those cases, any and all concerns, legalities, or liabilities, including but not limited to safety, injury, insurance, or medical, are entirely the responsibility of that program's managers, and Hard Work Martial Arts and its employees, owners, etc, are simply offering the use of the physical location, as is, and cannot be held responsible for any activities that occur due to the management or activity of those programs, both on Hard Work Martial Arts locations, as well as off.
• All Memberships: Purchaser understands that memberships cannot be canceled while any amount is past due, and may be
subject to collections actions at our discretion..
• All Memberships: Purchaser understands that there are no cancellations or refunds of any paid amounts or memberships without written approval by Hard Work Martial Arts and its representatives, purchasers may be credited amounts to be used for other provided services or memberships.
• All Memberships: Purchaser understands that this agreement, if canceled, does not release the buyer from obligation to pay the agreed amount.
• All Memberships: Purchaser understands that tuition payments are made regardless of attendance for the duration of the membership.
• All Memberships: Purchaser certifies that the attendee(s) is in good health.
• All Memberships: Purchaser understands that Hard Work Martial Arts and its representatives reserve the right to cancel this membership agreement for any reason with or without notice.
• All Memberships: Putting Memberships on Hold: Purchaser understands that memberships may be put on a hold for up to 3 consecutive months with written notice, emailed to Info@HardWorkMA.com or HardWorkMA@Gmail.com . Memberships put on hold do not release the buyer from any financial obligation, and any duration of time passed on memberships, such as a 1 year commitments, are paused for the duration, resuming at the resumption of the membership.
• Credit Reporting / Collections: Purchaser agrees that any past due amounts may be subject to collections actions, including referral to a collections agent, and/or reporting on credit ratings. Any additional costs for these are to be paid by the purchaser, and any information required to assist in this collection may be given to 3rd parties for this purpose.
• Transfers: Purchaser understands that memberships may be transferred from one type to another with Hard Work Martial Arts permission, and all contract and waiver responsibilities are still in full effect. This may result in financial credit given or additional payments required, at Hard Work Martial Arts discretion.
• Purchaser understands that this membership is intended with honest and fair interpretation. If there is disagreement on the intention or wording of this membership, Hard Work Martial Arts, and it's affiliates have final say on how aspects of the membership agreement are to be intended and interpreted.

Waiver of Liability
When signed by a parent or guardian, the parent or guardian is affirming the below mentioned in regard to the student participating in any programs.
I hereby acknowledge and agree that the activity of martial arts training and instruction is a contact sport, which involves the risk of serious bodily injury and property damage during participation in martial arts activities, events, practice sessions or other instruction. I understand that in addition to physical risks, I may also be exposed to any pathogens, viruses, bacteria or any other causes of potential illness that may be present at attendance locations. I also acknowledge and agree that my participation in martial arts training and instruction at the school is totally voluntary, and I expressly assume the risk and responsibility for any
injury resulting from my participation up to and including death. This includes any other Hard Work Martial Arts sponsored activity or program both on property or outside of it, that may not include martial arts training. As a condition for my acceptance into the Hard Work Martial Arts programs, I represent that my
health condition is good and I am not suffering from any heart, lung or other bodily ailments and I have no physical limitations that would prevent me from safely participating in this activity.
Students and guardians have been advised that strict observance of the rules and regulations relative to martial arts self-defense training is mandated and includes the use of protective equipment. The school does not warrant that the protective equipment will completely eliminate the possibility of accident, injury or death but may reduce the risk of accident, injury or death. Physical contact may be used by employees of the school, other students and authorized individuals, as part of the course of
instruction, field trip, or other Hard Work Martial Arts sponsored activity. Students have been advised of such facts and give full consent to any physical contact as may be required or customary to services required or rendered.
Photography & Video Permission
HWMA will strive to use images provided to us in a manner serving you, the public trust, and our community. In that regard, I give Hard Work Martial Arts, its directors, officers, employees, agents, and designees (collectively “HWMA”) non-revocable permission to capture images and likeness in photographs, videotapes, motion pictures, recordings, or any other media (collectively “Images”) of me, or any enrolled students of which I am a parent or guardian. I acknowledge that HWMA will own such Images and further grant the HWMA permission to copyright, display, publish, distribute, use, modify, print and reprint such Images in any manner whatsoever related to HWMA business, including without limitation, publications, advertisements, brochures, website images, or other electronic displays and transmissions thereof. I forever release and hold the HWMA harmless from any and all liability arising out of the use of the Images in any manner or media whatsoever, and waive any and all claims and causes of action relating to use of the Images.
